Welcome to LevelUp. These Terms govern your access to and use of the LevelUp platform, website, and related services (the “Platform”). By creating an account or using the Platform, you agree to be bound by these Terms.

• Student: Any individual who registers to receive tutoring or learning services.
• Tutor: Any qualified educator or service provider who offers tutoring via the Platform.
• Platform: The LevelUp website, applications, and associated interfaces, features, and services.

• You must provide accurate information, keep your credentials secure, and notify us promptly of unauthorized use.
• We may suspend or terminate accounts that breach these Terms or applicable law.
• If you are under the age required by your local laws to consent to online services, you may only use the Platform with appropriate consent and supervision.

• All communications must remain within the Platform. Attempts to circumvent the Platform or solicit off‑platform sessions may lead to suspension and legal action.
• All lessons must take place on the Platform.
• Do not misuse the Platform, interfere with its operation, or upload content that is unlawful, infringing, or harmful.
• You are responsible for the security of your devices and networks when accessing the Platform.

• Tutors may create and use their own notes and materials for Students on the Platform.
• LevelUp sets base pricing; Tutors may adjust their rates within the Platform. A service fee may apply to transactions.
• All video sessions and recorded lessons conducted via the Platform are the exclusive property of LevelUp International Academy.

• Students may not share Platform content, course materials, or recordings with third parties unless expressly permitted.
• Students are encouraged to complete related exercises and assignments to maximize educational outcomes.
• LevelUp is not responsible for academic results affected by non‑attendance, lack of participation, or incomplete assignments.

• Payments, plans, and subscriptions are processed via authorized third‑party providers. Additional terms of those providers may apply.
• Taxes, fees, and exchange rates (if any) are your responsibility unless stated otherwise.
• We may change prices or plan features from time to time; we will notify you where required by law or contract.

• Cancellation and rescheduling policies may vary by plan or session type and are subject to the Platform’s current policy.
• Refunds, where applicable, are provided at LevelUp’s discretion in accordance with the Platform’s refund policy and applicable law.

• All Platform software, branding, recordings, and original content are owned by LevelUp or its licensors and are protected by intellectual property laws.
• Except where expressly authorized, you may not reproduce, distribute, or create derivative works from Platform content.
• User‑generated content remains yours, but by uploading it to the Platform, you grant LevelUp a non‑exclusive, worldwide license to host and display such content for Platform operation.

Your use of the Platform is subject to our privacy practices. We process personal information in accordance with applicable data protection laws. See our Privacy Policy for details.

The Platform may integrate with third‑party services (e.g., payment processors, video providers). Your use of those services is subject to their terms, and LevelUp is not responsible for third‑party acts or omissions.

• The Platform is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law.
• To the maximum extent permitted by law, LevelUp’s total liability for claims arising out of or relating to the Platform will not exceed the service fees paid to LevelUp within the six (6) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless LevelUp, its affiliates, and personnel from and against any claims, losses, or liabilities arising from your breach of these Terms or misuse of the Platform.

• You may stop using the Platform at any time.
• We may suspend or terminate your access if you violate these Terms, misuse the Platform, or as required by law.

• These Terms are governed by the laws of South Africa.
• All disputes are subject to the exclusive jurisdiction of the courts of South Africa.

We may update these Terms from time to time. Material changes will be notified where required. Your continued use of the Platform constitutes acceptance of the updated Terms.
